Brian Varela, a 20-year-old Washington man, was sentenced to less than three years behind bars for raping a high school student who was dying from an overdose.
Varela was texting her semi-nude photos to his friends before attempting to dispose of her body.
Superior Court Judge Linda Kerse said that state guidelines limited Varela’s prison sentence to just 2 years and 10 months as he did not have a prior criminal record. This, according to the <a href="https://www.heraldnet.com/news/lol-suspect-allegedly-texted-about-overdose-rape-and-death/"> Herald Net </a>.
Kerse said she was “surprised” and “even outraged” by the inadequate sentence and called on lawmakers to examine the impact of such sentencing constraints.
In February, Varela pleaded guilty to second-degree manslaughter, third-degree rape and unlawful disposal of remains, as part of a plea deal in the death of 18-year-old Alyssa Noceda.
He told authorities they snorted Percocet and ingested a concentrated form of liquid THC during a party at his Lynnwood mobile home on the night of February 3rd.
Noceda collapsed in Varela’s room within minutes of taking the drugs, however, he did not seek help for her.
He decided he would send out a group text to friends that included a photo of Noceda semi-nude and unconscious, her lips swollen and blue, according to court documents obtained by the Herald.
“LOL I think she od’d, still breathing,” he wrote, adding that he was having sex with her to “pass the time.”
Tests later revealed Noceda had taken a fatal mix of fentanyl and alprazolam (generic for Xanax).
Varela stated that he played video games until he fell asleep and then went to work at Dairy Queen the following day.
One of his co-workers contacted the police after hearing Varela say he didn’t know whether or not Noceda was alive when he’d had sex with her.
According to court documents, he told a friend that “she died, having sex with me.”
Police executing a search warrant for Varela’s home and discovered Noceda’s body hidden in a plastic crate, after which they arrested Varela.
Varela told authorities he intended to bury her with onions in order to reduce the smell.
Varela also admitted he used Noceda’s thumb to unlock her phone and then sent out messages after her death to make it seem as though she had run away. (I knew there was a reason I never liked that setting on a phone).
“I’m sorry for my foolish actions,” Varela said before his sentencing on Thursday. “What I get is what I deserve.”
Noceda’s mother, Gina Pierson, told KOMO-TV Varela’s 36-month sentence was “a joke.”
“Usually people who do stuff like this don’t get away with a slap on the wrist,” she added, emphasizing her intentions to fight legislature that limited Varela’s prison sentence. “I just keep thinking I’ll never see her again.”
