There's more disarray today in a ruling from infamous California's 9th Circuit Court of Appeals, as underage illegal aliens with gang affiliation can't be held in custody indefinitely by ICE, and bright to a release hearing before an immigration Judge as soon as they're arrested.
The ruling goes against guidelines set forth by the Trump Administration and the Department of Justice, which Attorney General Jeff Sessions ordered to stop the MS-13 gang and their rise to power.
Brutal and horrendous crimes have been committed in recent years at the hands of illegal aliens affiliated with the MS-13 syndicate, as well as similar gangs comprised of illegal aliens.
Just six days ago, <a href="https://thegoldwater.com/news/38066-California-s-Serial-Killer-Targeting-Homeless-Vets-is-an-Illegal-Alien-Deported-Six-Times"> an illegal alien was charged with serial-murdering homeless Veterans in California.</a>
With today's ruling, illegal aliens who are underage and found to have committed crimes related to gang activity would be granted the ability to remain with a family member, and avoid jail or prison.
This dangerous tactic of violating the federal laws risks the safety and security of American citizens.
Just this past summer, an<a href="https://thegoldwater.com/news/31358-Alabama-Illegals-Force-13-Year-Old-Girl-to-Watch-Murder-of-her-Grandmother-Then-Behead-Girl"> gang of illegal aliens in Alabama forced a 13-year-old autistic girl to watch her grandmother's murder before they beheaded the child.</a>
In October of 2017, <a href="http://www.thegoldwater.com/news/9494-Illegal-Immigrant-who-Admitted-to-Beheading-Mother-in-North-Carolina-has-Charges-Dropped"> an underage illegal alien beheaded a woman and was caught carrying the decapitated face of his victim by the hair as he walked down the street.</a>
In January, <a href="https://thegoldwater.com/news/16275-Illegal-Alien-who-Murdered-Two-Cops-in-California-I-Wish-I-d-Killed-More-of-The-Motherf-ckers"> an Illegal Alien murdered two California police officers, and later said, “I wish I'd of killed more of the mother fuckers.”</a>
In May, a<a href="https://thegoldwater.com/news/27538-Michigan-Twice-Deported-Illegal-Killed-Girlfriend-14-Month-Old-Child-Still-Missing"> twice-deported illegal alien killed his girlfriend and kidnapped their 14-month-old child.</a>
In the same month,<a href="http://thegoldwater.com/news/27472-ICE-Revokes-and-Deports-Naturalized-Nigerian-After-Sexually-Abusing-7-Year-Old-Girl"> a Nigerian migrant involved in a Texas gang raped a 7-year-old girl.</a>
In July, <a href="https://thegoldwater.com/news/32004-Illegal-Alien-Who-Killed-NFL-Linebacker-Edwin-Jackson-and-Friend-Pleads-Guilty"> NFL Linebacker Edwin Jackson and his driver were killed when a drunken illegal alien struck them with a car.</a>

We need tough profiling methods. We need strong stances against gangs and illegal aliens. This is not a game, or in any way an effort to do anything but to protect Americans.
The Liberal-backing three-judge panel from the 9th District Court of Appeals attempted to quote an earlier Supreme Court ruling saying Constitutional Rights of due process must give "the opportunity to be heard in a meaningful way."
The problem is, these people do not have Constitutional Rights, a heavy-handed but truthful measure of legitimate freedoms that the media seemingly forgets doesn't apply to foreign invaders.
Illegal aliens are not covered in the Constitution, nor are they protected with such exonerated rights.
The ruling intended to uphold a preliminary injunction from last year, which was issued by U.S. District Judge Vince Chhabria of San Francisco.
The ruling was made in a lawsuit filed by three teenage illegal aliens, who were determined by the Immigration and Customs Enforcement (ICE) agency to have remained active in a criminal gang enterprise inside of two individual New York counties.
Those teenagers, both criminal illegal aliens and confirmed gang members, were held by ICE for three weeks pending deportation orders of further investigation, but the liberal Judge said they had to be released.
It didn't matter whether suspected in a string of homicides, narcotics trafficking affiliation, or whether they were low-level thugs; Judge Chhabria said they couldn't be held by ICE.
Now, the 9th Circuit has sided with them, in an unsurprising measure of liberal lunacy endangering the entire nation yet again.
12 total teenage gang members were arrested in a June of 2017 ICE raid that resulted in the apprehension of 45 total illegals, including 39 of which were MS-13 gang members.
“Chhabria's preliminary injunction requires undocumented youths who were previously placed with sponsors and then arrested to be given a hearing within seven days,” according to<a href="http://www.ktvu.com/news/undocumented-teens-accused-of-being-in-gangs-can-t-be-held-indefinitely-judge"> Local Fox Affiliate KTVU Channel 2 </a>in San Francisco.
Of course, the ACLU is now praising this ruling, despite the obvious stupidity of the decision.
ACLU attorney Stephen Kang said in a statement, "With this decision, young immigrants will get a meaningful chance to show that the accusations against them are unfair and unfounded."
This also comes after California recently signed 5 new dangerous gun control laws into action.

The 9th Circuit Court of Appeals has historically been problematic. They attempt to undermine all of the agenda of the Trump Administration at every turn.

The<a href="http://www.latimes.com/nation/nationnow/la-na-illegal-immigration-unaccompanied-minors-20140724-story.html"> Los Angeles Times </a>reports that there is a 117% increase in children coming across the border.
“There has been a 117% increase in apprehensions among unaccompanied children ages 12 and younger and a 12% increase among teenagers between the fiscal year 2013 and the first eight months of the fiscal year 2014, according to government statistics obtained through a Freedom of Information Act request by the Pew Research Center,” the LA Times report said. “Also, the number of unaccompanied girls that have been caught crossing the border illegally has increased more rapidly this year than the number of boys, Pew research found.”
"These under-12-year-old children who are coming across the border unaccompanied, many of them are coming from Honduras, Guatemala and El Salvador," said one of the authors of the study, Mark Lopez.
Younger criminal aliens are forced to cross the border, and oftentimes, traffic narcotics.
ICE says that is exactly who the MS-13 and similar gangs will now use for recruitment because they won't be able to keep them in custody.
The corrupt court has blood all over its hands and doesn't realize or care that Americans have died as a result of the flood of illegal aliens affiliated with the MS-13 gang, and similar gang activities.
